A woman from Fayetteville, Georgia who has fatally shot a man who after he left the scene of a hit-and-run car crash has been granted bond for a second time after she was indicted on new charges in June.

According to authorities, 22-year-old Hannah Renea Payne was granted a $320,000 bond Friday (September 27) and had previously been granted bond after being arrested on a murder charge for the May shooting death of 62-year-old Kenneth Herring.

On May 7, Payne allegedly followed Herring’s pickup truck after she saw it hit another vehicle in Clayton County. Police say Payne called 911 before following the truck for about a mile down to an intersection.

Payne then allegedly blocked the driver, who prosecutors say may have been having a diabetic attacked, with her Jeep. According to authorities, she then got out of her vehicle to confront him with a gun in her hand and, at some point, shot Herring in the abdomen, which killed him.

Prosecutors claim Payne ignored the 911 dispatcher who told her to stay at the initial hit-and-run scene and not to engage the driver.

After the shooting, a witness allegedly recorded a video that showed Payne changing her clothes before police arrived.

Matt Tucker, Payne’s attorney, said his client is claiming self-defense in the shooting, saying Herring bruised her and ripped her shirt. "It just seems like an unfortunate situation of a good Samaritan trying to stop a person on a hit-and-run," he previously said. 

Clayton County District Attorney Tracy Graham Lawson says Payne was the aggressor. During the tragic incident, Payne was recorded in the 911 call as saying “Get out of the car. Get out of the car,” which makes her sound like she thought she was a police officer and taking matters into her own hands.

After her initial arrest on a murder charge, Payne was granted a $100,000 bond and she was released. A grand jury then indicted her on additional charges in June of felony murder, malice murder, aggravated assault, false imprisonment and possession of a firearm during a felony, her bond was revoked and she was reimprisoned.

On Friday, a judge granted Payne bond for a second time after her attorney argued that his client wasn’t a flight risk.

As of Friday afternoon Hannah Payne has not bonded out of jail.
