The court drama between Halle Berry and her ex Gabriel Aubry is far from over. The Cloud Atlas star will go before a judge this week to seek an indefinite restraining order against Aubry. TMZ reports, Aubry allegedly instigated a fist fight with Berry's fiancé, Olivier Martinez, in front of Berry and Aubry's four-year-old daughter Nahla. 
The incident went down on Thanksgiving Day when Aubry came to Berry's home for a scheduled custody drop-off of Nahla. Martinez allegedly told Aubry "we have to move on" from the increasingly ugly custody battles, inciting the model-actor into a rage. The brawl landed both men in the hospital and Aubry in jail, though he was quickly released on $20,000 bail and a misdemeanor battery charge. 
A judge issued Berry an emergency order of protection, requiring Aubry to stay 100 yards away from his ex and daughter. A source says Berry will now attempt to extend the order indefinitely and will tell a judge that if Aubry can't control his temper in front of their child, he doesn't deserve custody.
