Man Arrested After Luring 14-Year-Old Sister of His Foreign Exchange Student Wife Into Sexual Relationship

The teen thought she was traveling from Spain to Miami for a fun holiday.

A Florida man who married a teen exchange student he was supervising was arrested and charged for luring her then 14-year-old sister to the U.S. and sexually assaulting her, said authorities.

Dale Leary, 50, was allowed to become a host for young exchange students despite the fact he was convicted of sexual assault in 1985, according to the Miami Herald. The conviction came after he sexually assaulted a woman and tied her up at gunpoint. He pleaded guilty to the attack, spent 60 days behind bars and served 13 years on probation.

However, in 2012 Marta San Jose came to Miami from Spain to live with Leary when she was only 16, according to the Miami-Dade Police Department. When Marta’s schooling was complete, Leary and the teen flew to Spain to convince her parents to let her stay in the U.S. another year.

Once Marta turned 18, Leary divorced his wife and married the teen, according to police. Marta’s parents were unaware of the marriage and allowed her 14-year-old sister to accompany her back to Miami. 

The unidentified sister eventually learned the two were married after she began living in Miami. At some point during the stay, Marta tricked her sister into thinking she had been molested as a child, and persuaded the 14-year-old to allow Leary to conduct a "vaginal examination," said police. Marta told her sister Leary would be able to determine if she’d been assaulted in the past.  

During the stay of Marta’s sister, Leary sexually assaulted the teen on numerous occasions, according to authorities. In addition, Marta and Leary had sex in the presence of the victim "several times,” said authorities.

Marta's younger sister, now 16, was eventually reunited with her parents, and the married couple now face several charges.

Leary and Marta, who is now 21, face multiple charges including lewd and lascivious conduct with a child under 16, according to the Herald. Marta pleaded not guilty on Wednesday, while Leary pleaded not guilty last week, according to the Herald.
