Motion To Set Aside Jonathan Majors’ Conviction Is Denied

The former Marvel actor is scheduled to be sentenced on April 8 after being found guilty in his domestic violence case.

A motion to set aside Jonathan Majors's conviction was denied in Manhattan court and he will face sentencing on Monday, April 8, CNN reports.

The charges are the result of a domestic dispute that took place between Majors and Grace Jabbari, his former girlfriend.

Arrested in New York City on March 25, 2023, after the alleged assault on Jabbari, Majors was convicted of one count of misdemeanor third-degree assault and one count of second-degree harassment, but acquitted of two other counts of assault and aggravated harassment in a split verdict in December 2023.

In his ruling, Judge Michael Gaffey stated his reasoning for denying the motion.

“Defendant first argues that his conviction of reckless assault in the third degree should be set aside because the court erred in submitting the count to the jury,” Gaffey wrote. “This Court disagrees. At the outset, contrary to Defendant’s contentions, the court submitted the count of reckless assault as an alternate theory to the intentional assault count, and not as a lesser included offense …there was a reasonable view of the evidence to support that Defendant acted recklessly.”

“Defendant next contends that the court should not have submitted the reckless assault count to the jury without a justification charge,” the order read. “This argument is wholly unpreserved, and as a result, this Court is without power to consider it. Certainly, on appeal, Defendant is free to request that the Appellate Term exercise its interest of justice jurisdiction and reach whether the court should have sua sponte charged justification, or whether trial counsel was ineffective for failing to request such charge.”

“Finally, the trial evidence was legally sufficient to establish Defendant’s guilt of harassment in the second degree,” Gaffey added. “Such evidence established that Defendant subjected Ms. Jabbari to physical contact, and the jury reasonably could have inferred his intent from the conduct and surrounding circumstances.”

In February,  Priya Chaudhry, Majors’ attorney filed a motion requesting that Judge Michael Gaffey “set aside the verdict and acquit him of the charges.”

In a statement, Chaudhry said that her client “feels disappointed by the outcome of the motion, yet he upholds respect for the process.”

“He continues to draw strength from his friends, fans, family, and dogs, harnessing his art and creativity,” the statement continued. “As he eagerly anticipates closing this chapter, he looks forward to redirecting his time and energy fully toward his family and his art.”

Majors faces up to a year in jail on the two counts.
