People Are Prepared to Fight for Transgender Protections After the Supreme Court Scrapped the Hearing of Gavin Grimm's Case
On Monday, the Supreme Court announced that Gavin Grimm’s monumental case for transgender rights will not be heard and will be sent to a lower appeals court. Grimm’s case challenges the Gloucester County School Board, which has a policy that forces individuals to use bathrooms that correspond to their biological sex.
The case — which received national attention for its plan to be heard in front of the SCOTUS — was rejected by the court after the Trump administration rescinded a transgender guidance put forth by the Obama administration. In the guidance, public schools were ordered to allow transgender students to use the bathroom of their choice or the schools would risk losing federal funding.
This case was important for the entire nation because it would have addressed whether or not the sex discrimination ban in Title IX of the Education Amendments of 1972 would also act as a ban on transgender discrimination. However, now the states are given the power to make such decisions, thanks to Trump’s recent reversal of the national order.
The U.S. Court of Appeals for the Fourth Circuit will be hearing Grimm’s case for the second time and will be asked to address the Title IX question.
