A legally blind Florida man, who was acquitted in the shooting death of another man, has successfully fought for his rights in court to get his guns back.

John Rogers argued that he has the right to have both of his guns returned to him and the judge presiding over his case, Judge John Galluzzo, found it hard to argue with him despite his misgivings. “I have to return property that was taken under the circumstance,” the judge said. “I have researched and haven’t found case law to say otherwise.”

Galluzzo said he had no choice but to return Rogers’s 10mm Glock and the rifle that was used to kill James DeWitt in March 2012.

Rogers has claimed that since his going blind he has needed his guns for protection. Rogers was acquitted of the murder charges against him under the famous Floridian "Stand Your Ground" laws.

In his closing statements, Rogers said, “The family has been through enough, and I have been through enough, and I would like to retire, put this behind me, and move forward.”

While Rogers will have his firearms returned to him, Judge Galluzzo did order that all of his ammunition be destroyed on the grounds that it was too old and dangerous.
