Diddy Scores First Win in Suit Against DeLeón Tequila

A judge denied requests to dismiss the case.

Music mogul Sean "Diddy" Combs is set to have his day in court in his lawsuit against the alcohol giant Diageo.

Last week, New York State Judge Joel M. Cohen—following over an hour of testimony—delivered his ruling, denying two motions by Diageo. The petition had sought to dismiss the case or have it move to arbitration for private settlement.

The case is now scheduled to proceed in state court, and the trial will be open to the public.

Following court, Diddy’s lawyer, John Hueston, spoke on the judgment, stating, “This case has always been about getting fair and equal treatment.” Hueston added, “Today’s decision is an important step in the right direction. Diageo tried to end this action. Today, the judge soundly rejected that effort.”

The Bad Boy Records founder added, “I’m fighting for fair and equal treatment for everyone.” The industry veteran noted that the lawsuit “isn’t just about me” and that he looked forward to “continuing this fight in court” before adding, “We all deserve the same 24 hours.”

Last June, the 53-year-old billionaire businessman filed a lawsuit against the British alcoholic beverage.  Diddy accused Diageo of negligence towards the joint brand, DeLeon Tequila, alleging that these actions were motivated by racial bias.

A spokesperson for Diego stated, “While we are disappointed with today’s procedural decision, it is important to underscore that this is not a ruling on the merits of the claims, which we maintain are false and baseless.” The organization noted that they were “currently considering all legal options.”
