Janet Jackson probably hoped that her wardrobe malfunction at the 2004 Super Bowl halftime show was finally left in the past, but the battle between CBS and the Federal Communications Commission wages on. The FCC has now asked the United States Supreme Court to reassess its decision to fine CBS $550,000 for airing a quick glimpse of Jackson's exposed breast.
The FCC filed the fine against CBS back in 2006 for breaking indecency rules, but in its ruling in November, the 3rd Circuit Court of Appeals in Philadelphia went in favor of the network saying the FCC acted "arbitrarily" and that the rule shouldn't apply to "fleeting images." But the Federal Communications is saying that "no such exemption has ever existed" for nudity and hopes that the fine will be reimposed.
Jackson performed live at the 2004 Super Bowl halftime show with Justin Timberlake when he tore off part of her bustier and accidentally exposed her right breast for a split second to 90 million viewers.
