A black father from Maryland filed a lawsuit against Six Flags America after he claimed he was beat and handcuffed by security guards.

Nicholaus Mims says a white female employee called for help during a dispute over him not wearing a shirt inside the park.

Over Father’s Day weekend, Mims and his family were visiting Six Flags America. The incident allegedly started when Mims’ 12-year-old son disappeared from the water park and he went to go look for the young boy.

The Washington Post obtained a lawsuit filed by Mims says he was with his son at Hurricane Harbor before the child ran off. The dad took off his shirt while at the water park and went searching for his boy. As he began running through the park guards told him it was against park rules not to have a shirt on.

Mims then explained what was going on and they let him continue searching. He eventually found his son safe and called his wife who had his shirt in her bag. According to Mims, a white female security guard later approached him and told him he needed to put a shirt on. He explained that his wife was on the way with his shirt and the employee activated her handheld radio device and called park security.

“Man, I told you, I’m waiting for my wife,” said Mims in court filings that recalled what he told security. “I don’t understand, I’ve spent all this money — almost $400 — to get into this park, and now you are telling me I have to leave because I don’t have a shirt on?”

Mims admitted to using an expletive and that’s when one of the security guards placed his hand on his mace and told the dad to leave.

According to his lawsuit, Mims responded, “What are you doing? Are you really about to mace me right in front of my son because I told you I don’t know what’s going on?”

Subsequently, the guards told him to leave again so he started walking toward the exit. Once they stepped outside the park’s gate, one of the security guards told him he was under arrest for disorderly conduct and grabbed his arm. He was thrown to the ground by several employees after pulling his arm away. He was bruised during the alleged attack.

“I could see if I was fighting with someone or not compliant, but I was leaving,” Mims said. “I broke the rules. That’s my bad, but that doesn’t mean you need to slam my face into the ground.”

Mims is seeking $10 million in damages in his lawsuit. Six Flags has responded and allege his story has no merit. They also deny any wrongdoing.
