Official Rules
These are the official terms and conditions for voting for "2023 BET Greatest Rap Crew of All Time Voting" (the "Official Voting Rules").
1. Eligibility
At the time of voting, voters must be at least thirteen (13) years of age or older. Employees and their immediate families (i.e., parents, spouse, children, siblings, grandparents, step parents, step children and step siblings) of Black Entertainment Television LLC ("BET" or "Sponsor"), Paramount Global, Telescope, Inc. ("Telescope" or "Vote Administrator") and each of their respective parent companies, subsidiaries and other affiliated companies, sponsors, advertising agencies and third party fulfillment agencies and their respective agents, employees, officers, directors, successors and assigns (collectively, the "Promotion Entities") are not eligible to participate in the Voting Promotion (hereinafter defined). Internet connection is required.
2. Overview
The BET Greatest Rap Crew of All Time Voting is a tournament-style bracket voting promotion (the "Voting Promotion") hosted by Black Entertainment Television in celebration of the 50th anniversary of hip hop for which the public will be invited to engage and cast votes for their favorite rap crews ("Nominees") from among 32 of the most recognized rap crews of all time over the six (6) week period commencing at or around 12:00:00 PM Eastern Daylight Time ("EDT") on May 1, 2023 and continuing through 12:00:00 PM (EDT) on June 9, 2023 (the "Voting Period"). There will be five (5) Rounds (each, a "Round') of voting to determine the winner. During each Round, the "Matchups" will be open for 48 or 72 hours. Not all Matchups in a Round will be open for voting at the same time. See Voting Period (Section 4) below.
3. Voting Methods, Availability and Limits
During the Voting Period (see Section 4), fans may submit their vote for active Matchups via the below Voting Methods. There are four (4) Voting Methods available.
- Online Bracket Voting
- Online Battle Poll Voting
- Twitter Hashtag Voting
- Instagram Hashtag Voting via Comments on a Post
The Online Bracket Voting, Online Battle Poll Voting, Twitter Hashtag Voting and Instagram Hashtag Voting via Comments on a Post, are referred to herein, collectively, as the "Voting Methods." Sponsor reserves the right to modify the Voting Methods and add or remove any of the available Voting Methods at any time during the Voting Period, at its sole discretion, with or without prior notice.
3.1 Online Bracket Voting
Fans may vote by visiting https://bet.com/grcoatvote ("Online Bracket Voting"). Once they have reached the Online Bracket Voting site, they will register by providing full name, email address, and date of birth, and confirm acceptance of the Official Voting Rules, and website Terms of Service and Privacy Policy. Fans will have the ability to opt in to receive marketing communications from BET Networks and opt-in to participate in the BET Greatest Rap Crew of All Time Voting Promotion and Sweepstakes [https://bet.com/grcoat-sweepstake-rules] by checking the appropriate check boxes on the registration form.
Fans vote for their favorite Nominee from the active Matchups by clicking on the "Vote" button or by clicking on the Nominee thumbnail image on the bracket grid to open the Nominee Vote Modal. Once fans click on the "Vote" button from within the Nominee Vote Modal to cast their vote, they will see a Thank You Modal confirming their vote. Fans can return to the bracket grid to view their votes in the current Round and may continue to vote for any other active Matchups for which they have not already submitted a vote.
Fans are limited to one (1) vote per Matchup, per valid email address, per Round during the Voting Period.
3.2 Online Battle Poll Voting
Fans may vote in a Battle Poll by navigating to an article embed on BET.com featuring a Battle Poll Matchup vote, complete the registration form with full name, email address, and date of birth, and confirm acceptance of the Official Voting Rules, and website Terms of Service and Privacy Policy. Fans will have the ability to opt in to receive marketing communications from BET Networks and opt-in to participate in the BET Greatest Rap Crew of All Time Voting Promotion and Sweepstakes [https://bet.com/grcoat-sweepstake-rules] by checking the appropriate check boxes on the registration form.
Fans can vote for their favorite Nominee in the Battle Poll Matchup by clicking on the button that includes the Nominee name of their choice. Fans will see a confirmation message for their vote.
Fans are limited to one (1) vote per Battle Poll Matchup, per valid email address, per Round during the Voting Period.
3.3 Twitter Hashtag Voting
Fans may vote via Twitter hashtag ("Twitter Voting"). To vote via Twitter, users must have a valid Twitter account (visit Twitter.com to register for a free account) and have their account privacy settings set to public. Twitter votes must be initiated by the authorized Twitter account holder. Twitter votes will only be recognized from Twitter accounts which are public. To vote during the Voting Period, post or retweet a public Twitter message (i.e., a tweet) containing the designated campaign hashtag (#BETGreatestRapCrew), plus one (1) designated Nominee hashtag. If more than one (1) designated nominee hashtag is contained in a tweet, the tweet is considered invalid and none of the votes in that tweet will count. By utilizing Twitter to participate in this Voting Promotion, participants agree to comply with the Terms of Service of Twitter (https://twitter.com/en/tos)
Fans are limited to one (1) vote per Nominee Matchup, per Round, per Twitter ID during the Voting Period.

3.4 Instagram Hashtag Voting via Comments on a Post
Fans may vote via Instagram ("Instagram Voting"). To vote via Instagram, users must have a valid Instagram account (visit Instagram.com to register for a free account) and have their account privacy settings set to public. Instagram votes must be initialized by the authorized Instagram account holder. Instagram votes will only be recognized from Instagram accounts which are public. To vote during the Voting Period, users must comment on a Call-To-Action Post from BET Networks (https://www.instagram.com/bet/) using the designated campaign hashtag (#BETGreatestRapCrew), plus one (1) designated Nominee hashtag. If more than one (1) designated nominee hashtag is contained in a comment, the comment is considered invalid and none of the votes in that comment will count. By utilizing Instagram to participate in this Voting Promotion, participants agree to comply with the Terms of Service of Instagram (https://help.instagram.com/581066165581870/?helpref=uf_share)
Fans are limited to one (1) vote per Nominee Matchup, per Round, per Instagram handle during the Voting Period.

4. Voting Period
Voting will be available for all Voting Methods beginning at or around 12:00:00 PM (EDT) on the Vote Open Date noted below for each Round and "Matchup", except for Twitter Hashtag Voting which will be available for Rounds 1, 2, and 3 only.Voting for the "Matchups" in Rounds 1, 2, 3 and 4 will be open for forty-eight (48) hours and voting for all Matchups in Round 5 will be open for seventy-two (72) hours. closing at or around 12:00:00 PM (EDT) on the Vote Close Date. Round/"Matchup" numbers do not indicate the Matchup position in the Bracket Vote.
Including this language, but it is up to BET if you want to announce this now or later when we are closer to the final rounds and/or to wait in case anything changes with Twitter.

The total number of votes submitted during the Voting Period for the Nominees will be tabulated by the Vote Administrator and the Nominee with the most votes, as determined by the Vote Administrator, will be declared the winner. If, for any reason, this Voting Promotion is interrupted for any reason, is found to have been tampered with in any way, or for any other reason that Sponsor believes in its sole discretion to be reasonably necessary, Sponsor reserves the right to select the winners at its discretion and may take into consideration the number of votes received by a Nominee up until the time of the interruption or cancelation of the Voting Promotion.
If, for any reason, any aspect of this Voting Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical or system failures or disruption, 'Acts of God' or terrorist attacks, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Voting Promotion or for any reason Sponsor deems necessary, Sponsor reserves the right at its sole discretion to cancel, terminate, amend, modify, extend or suspend the Voting Promotion and reserves the right in its sole discretion to determine the winners.
5. General Terms
You participate in this Voting Promotion at your own risk. The Promotion Entities and any other entity associated with this Voting Promotion (including, any social media platform used to submit an official vote) (collectively, the "Released Parties") are not responsible for and shall not be liable for: (a) difficulty accessing the internet; (b) errors in transmission; (c) service outage or delays or for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of any technical problems or traffic congestion on the Internet or at any web site or combination thereof; (d) any incomplete, lost, late, delayed, misdirected or garbled votes or failure to receive votes; (e) injury or damage to you or to any other person's computer or mobile phone related to or resulting from participating in, or downloading materials or software, or attempts to participate in or download materials or software related to this Voting Promotion; or (f) failures or malfunctions of phones (including wireless phones/handsets), phone lines or telephone systems, cellular equipment towers, telephone systems or wireless services or other communications malfunctions. The Released Parties are not responsible for and shall not be liable for: (i) any condition caused by events beyond the control of the Released Parties that may cause the voting to be disrupted or corrupted; (ii) typographical or other errors in the printing, the offering, or the administration of these Official Voting Rules or the Voting Promotion; or (iii) any errors in the announcement of winners.
Participants assume all liability for any injury or damages caused or claimed to be caused by his or her participation in the voting opportunity described in these Official Voting Rules, and release the Released Parties from any such claim or liability.
By participating in this Voting Promotion, you agree to be bound by these Official Voting Rules. Failure to comply with the Official Voting Rules may result in a voter's disqualification solely at the discretion of Sponsor. Sponsor reserves the right to modify these Official Voting Rules at any time in its sole discretion.
All interpretations of these Official Voting Rules and the decisions of Sponsor relating to this Voting Promotion are final.

Once logged in, you must submit one (1) vote on any open matchup in the bracket during the applicable Weekly Bracket Voting Period to receive one "Entry" into the Sweepstakes.
For Battle Poll Voting: During the applicable Weekly Battle Poll Voting Period, navigate to an article embed on bet.com featuring a Battle Poll matchup vote, complete the registration form with your full name, date of birth, email address, and confirm acceptance of the Official Voting Rules, and website Terms of Service and Privacy Policy, and check the box acknowledging that you have read and agree to these Official Rules. The Weekly Bracket Voting Periods and the Weekly Battle Poll Voting Periods shall be individually referred to as the "Voting Period" and collectively, as the "Voting Periods"). Voting Periods will commence at or around 12:00:00 PM (EDT) on the Starting Date and concluding at 12:00:00 PM (EDT) on the Ending Date for each of the Voting Periods listed above.
Limit one (1) entry per person each Weekly Bracket Voting Period and each Weekly Battle Poll Voting Period, for up to a maximum of two (2) entries per person per week and up to a maximum of twelve (12) entries per person in total over the duration of the Sweepstakes. All Entries submitted in accordance with these Official Rules shall be hereinafter referred to as ("Eligible Entries"). The odds of winning the Sweepstakes depend on the number of Eligible Entries received.
Participants are strictly prohibited from incentivizing votes in any manner or means including but not limited to: offering or accepting any favor, prizes, consideration, access, product, service, follow back, reward, special content, personal contact or the promotion of any such exchange. PARTICIPANTS ARE STRICTLY PROHIBITED FROM VOTING BASED ON THE FOLLOWING: RACE, GENDER, COLOR, RELIGION, SEX, NATIONAL ORIGIN, AGE, MARITAL STATUS, DISABILITY, MEDICAL CONDITION, SEXUAL ORIENTATION, CITIZENSHIP, OR ANY OTHER BASIS PROTECTED BY APPLICABLE FEDERAL, STATE, OR LOCAL LAW, DECREE, ORDINANCE OR REGULATION. The use of automated voting, voting exchanges, outsourced voting or proxy voting is strictly prohibited. Any attempt by a Participant to rig the voting process and/or any attempt to cast votes that were exchanged, bought, received by the same person from multiple accounts, or that are otherwise in violation of these Official Rules, will be disqualified. Votes that are in violation of these Official Rules, incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion (including, without limitation, at the Voting Site's and/or any other entity's servers), are void and will not be accepted. Any attempted form of Voting other than as described herein shall be null and void. All votes must be cast within the applicable Voting Period in order to be counted. The last Voting Period ends at 12:00PM (EDT) on June 9, 2023. SUBMITTED VOTES REPRESENT SOLELY THE VIEWS/OPINIONS OF THE VOTERS AND DO NOT REFLECT THE VIEWS/OPINIONS OF THE PROMOTION ENTITIES IN ANY MANNER. The Voting Site may not be supported by older devices and/or browsers. If Voters are experiencing any issues casting votes, Voters may contact the Vote Administrator by email at info@telescope.tv.. If Participants use a web-enabled mobile device to participate in this Promotion, data rates may apply (Participants should contact their service provider for data rates/plans).
5. Winner Determination, Notification and Verification: At the conclusion of the Promotion Period, Sponsor will randomly select the one (1) Grand Prize Winner, the one (1) Second Prize Winner and the one (1) Third Prize Winner from among all Eligible Entries received. Sponsor disclaims any liability from, and Entrants, whether or not selected as a Winner, agree to waive, any claims against Sponsor relating to the winner selection or awarding process. Sponsor reserves the right to select an alternate Winner in the event that an originally selected Winner fails to comply with these Official Rules. To the extent permitted by law, Sponsor disclaims any liability from, and Entrants, whether or not a Winner, agree to waive, any claims against Sponsor relating to the judging or prize awarding process.
The Winners will be selected and notified on or around June 10, 2023. Sponsor will make up to two (2) attempts over the seventy-two (72) hour period following the potential Winners' selection to contact each potential Winner via the email addresses provided during the registration process for the Sweepstakes. If a potential Winner cannot be reached during the seventy-two (72) hour period in which they are emailed, the potential Winner will be disqualified and an alternate Winner will be selected at random from among the remaining applicable Eligible Entries received, time permitting.
A potential Winner must prove eligibility, including, without limitation, proof of age and residence within forty-eight (48) hours of being notified as a potential Winner. In the event of non-compliance by a potential Winner, such potential Winner shall be disqualified and all privileges otherwise due as a Winner shall be terminated and an alternate potential Winner may be chosen from among all of the remaining applicable Eligible Entries received in Sponsor's' sole discretion. Winner must sign within forty-eight (48) hours of receipt of such documents from Sponsor: (a) an affidavit of eligibility and release of Promotion Entities from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Promotion or the use/misuse or acceptance of the Prize or any portion thereof to be eligible for the Prize; and (b) except where prohibited by law, a promotional release granting the Promotion Entities the right to use Winner's name and likeness for advertising and publicity purposes without additional compensation. Entry into this Sweepstakes constitutes agreement to sign such releases. Winner also must acknowledge that the Promotion Entities have not and will not obtain or provide insurance of any kind relating to the Prize and that Winner will be responsible for obtaining and paying for any life, travel, accident, property or other form of insurance relating to the Prize. Each Winner must also complete any additional legal documents provided by Sponsor (or third party on its behalf, if applicable) with respect to the Prize and return them as instructed within the timeframe specified by Sponsor or such Winner may forfeit the Prize at Sponsor's sole discretion. All decisions of Sponsor relating to the Promotion are final. Sponsor expressly reserves the right to delay the announcement of the Winners for creative or technical reasons or for any other reason Sponsor deems necessary.
6. Prizes:
Grand Prize (1): The one (1) Grand Prize Winner will receive a two (2) night trip for Grand Prize Winner and one (1) guest (the "Guest") to Los Angeles, CA to attend the 2023 BET Awards Show on June 25, 2023. The trip will include: (a) round-trip coach airfare for Grand Prize Winner and their one (1) Guest between a gateway airport in the fifty (50) United States or the District of Columbia nearest to Grand Prize Winner's primary home and Los Angeles, CA (if Grand Prize Winner resides within a 150 mile radius of Los Angeles, CA, airfare for Grand Prize Winner and Guest will be replaced with ground transportation), (b) two (2) nights' standard hotel accommodation (one standard room, double occupancy, room and tax only) at a hotel in Los Angeles, CA (as determined by Sponsor in its sole discretion), (c) roundtrip ground transportation for Grand Prize Winner and Guest between the airport and hotel in Los Angeles, CA, (d )a $500 meal voucher and (e) two (2) tickets to the 2023 BET Awards (collectively, the "Grand Prize").
Trip fulfillment is subject to availability and airline seat availability. The trip may not be sold, traded, transferred, refunded, commissioned or redeemed for cash value elements may not be substituted by Grand Prize Winner.
Grand Prize Terms: Travel dates and arrangements are subject to air travel, holiday, blackout dates, and other prize and travel restrictions. Travel dates are subject to Sponsor approval. Reservations are subject to availability. If Grand Prize Winner elects to partake in any or all portions of the Grand Prize with no Guest, the Grand Prize will be awarded to Grand Prize Winner and any remainder of the Grand Prize will be forfeited and shall not be subject to further or alternative compensation. All elements of the Grand Prize must be redeemed at the same time, and no changes will be permitted after confirmation of any redemption. Guest accompanying Grand Winner must be at least eighteen (18) years of age at time of prize fulfillment and must travel on the same itinerary and at the same time as the Grand Prize Winner. Guest will be required to provide a form of government-issued ID and sign Sponsor's standard prize release/liability forms as a condition of partaking in any Grand Prize-related activity. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Sponsor and prize providers shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any Grand Prize-related services or accommodations. Additional prize award details and travel information to be provided to the Grand Prize Winner at the time of notification.
A potential Grand Prize Winner is not a recipient of the Grand Prize until they have been verified as the Grand Prize Winner by the Sponsor. Upon finalizing all travel arrangements for Grand Prize Winner and their Guest, Sponsor will be deemed to have awarded the Grand Prize to the Grand Prize Winner and Grand Prize Winner assumes full responsibility for their prize. If for any reason whatsoever Grand Prize Winner is unable to travel after all arrangements have been made and paid, Sponsor shall have no further obligation to such Grand Prize Winner. Grand Prize Winner will be solely responsible for paying all applicable federal, state or local taxes on the Grand Prize based upon the value of the Grand Prize as set forth in these Official Rules and will be issued an IRS form 1099 for the value as published in these Official Rules.
Second Prize (1): The Second Prize Winner will receive one (1) BET "swag bag" consisting of one (1) set of Beats Studio Buds, one (1) BET t-shirt and one (1) BET branded record player (collectively, the "Second Prize").
Third Prize (1): The Third Prize Winner will receive: one (1) BET "swag bag" consisting of one (1) set of Beats Studio Buds and one (1) BET t-shirt (collectively, the "Third Prize").
The Grand Prize, the Second Prize and the Third Prize shall be collectively referred to as the "Prizes".
The approximate retail value ("ARV") of the Grand Prize is $4,500, the ARV of the Second Prize is $284.78, the ARV of the Third Prize is $179.98 and the total ARV of all Prizes to be awarded in this Sweepstakes is $4,965. The ARV of the Prizes is subject to change based on current market conditions at time of prize fulfillment, and, with respect to the Grand Prize, the point of origination of the trip. Any difference between the ARV and the actual value, if any, will not be rewarded. Arrangements for fulfillment of the Prizes will be made by Sponsor. Fulfillment of the Grand Prize is anticipated to take place between June 17, 2023 and June 19, 2023 and fulfillment of the Second Prize and the Third Prize is anticipated to take place within approximately four (4) to six (6) weeks of the verification of the Winners. All costs and expenses not specifically listed above, including, without limitation, with respect to the Grand Prize, ground transportation not specifically set forth herein, meals, gratuities, souvenirs and incidentals are solely Grand Prize Winner's responsibility. The value of the Prizes may be taxable to Winners as income. Upon entry into the Sweepstakes, Winners (as well as all other participants) are required to comply with any and all applicable federal, state, and local laws, rules, and regulations. All federal, state and local taxes, and any other costs not specifically provided for in these Official Rules are solely Winner's responsibility. Promotion Entities shall have no responsibility or obligation to any Winner or potential Winner who is unable or unavailable to accept or utilize a Prize as described herein.
No substitution, transfer or cash equivalent of the Prizes or any portion thereof is permitted, except by Sponsor in which case a prize of comparable or greater value may be awarded. All details related to the Prizes shall be solely determined by Sponsor in its sole discretion and prize elements may be subject to additional restrictions.
7. General Conditions: By participating in this Promotion, each Participant agrees to: (a) be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects; (b) waive any right to claim ambiguity with these Official Rules; (c) indemnify and hold harmless the Promotion Entities and their respective parent, subsidiary and/or affiliate entities, licensees, sublicensees, and the officers, directors, employees, agents, attorneys, successors, and assigns of each of the foregoing ("each a "Released Party" and collectively "Released Parties" from any and all claims or liability (now known or hereafter arising), including but not limited to any claims for defense and/or indemnity, resulting or arising from: (i) use of any submitted Vote, (ii)) participation in this Promotion and/or (iii) use, misuse, or redemption of a Prize and (d) acknowledge compliance with these Official Rules. If, for any reason, the Promotion is not capable of running as originally planned, the Sponsor, in its sole discretion, reserves the right to cancel, suspend or modify the Promotion or any portion(s) thereof and calculate the Votes and award the Prizes from all Eligible Entries received prior to and/or after (as appropriate) the action taken by Sponsor, or award the Prizes in a manner that is fair and equitable and notice of such action will be posted on bet.com/grcoat. Any Participant attempting to defraud or in any way tamper with this Promotion will be ineligible for a Prize and may be prosecuted to the full extent of the law.
8. Disclaimers: The Released Parties shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience, or irregularity that may be caused by or have contributed to: (1) any wrongful, negligent, or unauthorized act or omission on the part of prize supplier(s) or any of its agents, servants, employees, or independent contractors, (2) any wrongful, negligent, or unauthorized act or omission on the part of any other person or entity not an employee of the Sponsor, or (3) any other cause, condition or event whatsoever beyond the control of the Promotion Entities. Participants hereby acknowledge that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any Prize, including express warranties provided exclusively by a prize supplier that are sent along with a Prize. The failure of the Released Parties to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, demonstrations, riot, earthquake, terrorism, act of public enemies, strikes, epidemics, pandemics, actions of governmental authorities outside of the control of the Released Parties (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
9. The Released Parties are not responsible or liable for Votes or Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), or for Votes or Entries that are late, tampered with, forged, incomplete, misdirected, deleted, damaged, lost, stolen, destroyed, dropped, inaccessible, corrupted, jumbled, duplicated, or otherwise not in compliance with these Official Rules and such Votes/Entries will be disqualified. The Promotion Entities assume no responsibility for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in the Promotion or by any human, mechanical or electronic error which may occur in the processing of the votes or Entries in the Promotion. The Promotion Entities are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in the Promotion. The Promotion Entities are not responsible for any typographical or other error in the printing of the offer, administration of the Promotion, errors in processing entries and/or votes, identifying the Winners or in the announcement of the Prizes and Winners. If, for any reason, the Promotion is not capable of running as planned, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Promotion Entities which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion. Should the Promotion be terminated prior to the stated expiration date, notice will be posted on bet.com/grcoat during the Promotion Period and the Prizes may be awarded to winners to be selected from among all Eligible Entries received up until and, or after (if applicable) the time of modification, cancellation or termination or in a manner that is fair and equitable as determined by Sponsor. All interpretations of these Official Rules and decisions by Sponsor are final. No software-generated, robotic, programmed, script, macro or other automated online or text message entries or votes are permitted. Sponsor reserves the right in its sole discretion to disqualify any individual they suspect or find (a) to have used a software generated, robotic, programmed, script, macro or other automated online or text message Entry or vote, (b) to have tampered with the voting process, the entry process or the operation of the Promotion, (c) to be acting in violation of these Official Rules, (d) to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (e) to have provided inaccurate information on any legal documents submitted in connection with the Promotion. Entrants agree to indemnify and hold harmless the Promotion Entities from any and all liability resulting or arising from the Promotion, to release all rights to bring any claim, action or proceeding against the Promotion Entities, and hereby acknowledge that Promotion Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prizes, including express warranties provided exclusively by a prize supplier that are sent along with the Prizes.
10. GOVERNING LAW AND JURISDICTION: This Promotion shall be construed and governed according to the laws of the U.S. and the state of New York. Any controversy or claim arising out of or relating to (i) this Promotion, (ii) the awarding or redemption of the Prizes, and/or, (iii) the determination of the scope or applicability of these Official Rules or their enforcement or interpretation shall be governed by and construed in accordance with the substantive laws of the state of New York without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state's laws. Winners agree that his/her/their claim, if any, will be resolved individually, without resort to any form of class action. Winners further agree that any claim/judgment/award shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Promotion but in no event attorneys' fees; and, under no circumstances, will a Winner be entitled to awards. Winners hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or increased. Should any term of this section be deemed by a tribunal of competent jurisdiction void, unenforceable or contrary to law, such term shall, but only to the extent necessary to bring this section within the requirements of law, be deemed to be severed from the other terms of these Official Rules, and the remainder of these Official Rules shall be given effect as if it had not included the severed term herein. THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
11. Privacy Policy: Any personal information supplied by Participants to the Sponsor or its affiliates will be subject to the Sponsor's Privacy Policy https://privacy.paramount.com/en/policy?r=www.bet.com and Terms of Use https://www.bet.com/legal/o3ccr8/terms-of-use . Each policy may be modified from time to time. If a participant chooses to opt-in to receive communications from a participating Promotion Entity, their information will be subject to that Promotion Entity's privacy policy and terms of service (if applicable), and such Participant agrees to receive additional email communication from that particular Promotion Entity. Opting in to receive communications does not affect an entrant's chance of winning. Entrants understand, agree, and consent that any personally identifiable information provided to Sponsor may be retained and used for the purposes of this Promotion (including but not limited to as applicable: record keeping, tax forms, and/or any prize fulfillment related obligations). Sponsor does not and will not sell the personally identifiable information of any entrant. Furthermore, Sponsor will not share or disclose any personally identifiable information to any third-party company or business unrelated to the Promotion.
