Delaware NAACP Calls For Independent Probe After Police Shooting In New Castle

Tremaine Jackson, 28, was killed after two troopers accused him of shoplifting several items from a hardware store.

The Delaware NAACP is calling for an independent probe following a fatal shooting of a 28 year-old Black man by law enforcement, CBS News reports.

Tremaine Jackson, 28, was killed after two troopers accused him of shoplifting several items from a hardware store last Thursday (Aug. 31) in New Castle. According to the officer's account, Jackson allegedly resisted arrest and drove from the scene in his vehicle. One of the troopers got pinned between Jackson's driver's side door and a guardrail.

Jackson allegedly refused to stop and two officers opened fire on him, fearing for their safety.

Following the incident, Jackson was rushed to an area hospital, where he was pronounced dead.

In a news conference on Wednesday (Sept. 6), Coby Owens, an attorney with the Delaware NAACP State Conference of Branches, said that he’s requesting  body-cam footage and any video of the incident to be released to the family and their legal team and for the officers involved in the fatal shooting to be  "investigated and be held accountable for their actions." He also called upon David Weiss and U.S. Attorney General Merrick Garland to open up an investigation arguing that a police-led investigation by the state would create a conflict of interest.

"It looks like it was the state trooper's car that came to the side and pinned him against a rail. That's just my view of it," Owens said.

"There was a place where they took him at and there was no witness or nothing. Now it's their word between his word, and he cannot speak up now because he's dead," Richard Smith, the president of the Delaware NAACP, added.

The Delaware State Police, which described Jacksson as a “known fugitive”, would not commit to releasing the footage in a statement.

“Delaware State Police were attempting to arrest Mr. Jackson because he was suspected of committing numerous criminal offenses and had active warrants for his arrest," said Sgt. India Sturgis, a police spokesperson. "The decision by DSP troopers to use deadly force against Mr. Jackson in response to his resisting that arrest is being investigated by the Delaware Department of Justice and that investigation will focus on the appropriateness of their use of force.”

"We ask for the public’s patience as that investigation proceeds and anticipate details being shared with the public at the conclusion of the investigation."

Island Clark, Jackson’s ex-girlfriend, shared how shocking it was to learn of his death at the news conference.

"Like, why?" Clark said. "I just want justice for him, and I just want answers.”

Jackson leaves behind three sons he shared with Clark ages 7,6, and 5.

"I'm angry, I'm hurt, I'm sad, I'm frustrated, I'm furious, I'm mad at the world, I'm mad at myself. I don't know how to feel," Clark said.

The state police department said that two officers involved in the fatal shooting have been placed on administrative leave while the investigation is ongoing.
