One month after Michael Dunn was convicted of three counts of attempted murder on the evening of Jordan Davis’s death, there is something of a legal skirmish as to when he will be sentenced.
For now, a judge in Jacksonville has postponed that decision until the end of the week. At issue is the fact that Dunn is expected to stand trial on first-degree murder charges in the killing of Jordan Davis after an argument in a Jacksonville convenience-store parking lot.
Cory Strolla, Dunn’s attorney, has asked that the sentencing be postponed until that second trial is completed. Strolla also said he intends to step down as Dunn’s attorney and asked the judge to appoint a public defender.
John Phillips, a lawyer for the parents of Jordan Davis, said that he sees no need to postpone the sentencing.
“I don’t understand what difference it should make in postponing the sentencing when he’s facing 60 years in jail,” Phillips said, in an interview with BET.com. 
“Any concern for Michael Dunn for having to testify again isn’t that big of an issue when he’s already been convicted of three charges and facing what’s essentially a life sentence,” Phillips said.
Davis and his friends were playing music loudly in an SUV next to Dunn's car. The 47-year-old Dunn demanded that the music be turned off before firing the shots that killed Davis. Nine bullet holes were found on the SUV, according to a detective.
On Feb. 15, Dunn was found guilty of the three charges, which, combined, carry a sentence of 60 years in prison. However, the jury was deadlocked on whether to convict him of first-degree murder in the death of the unarmed 17-year-old Black high school student, Jordan Davis. Prosecutors say they intend to retry Dunn on the first-degree murder charge.
