$10 Million Lawsuit Comes Back to Haunt Justin Bieber, Usher

Appeals court finds evidence of copyright infringement in "Somebody to Love" single.

A $10 million copyright infringement lawsuit against Justin Bieber and Usher has been reinstated and will go to trial, a U.S. Circuit Court of Appeals decided Thursday. 

In 2013, singer Devin Copeland and songwriting collaborator Mareio Overton sued Bieber and Usher over the 2010 single “Somebody to Love.” Copeland, who performs under the name De Rico, claims the song shares the same lyrics and composition as his 2008 song of the same name.

"After listening to the Copeland song and the Bieber and Usher songs as wholes, we conclude that their choruses are similar enough and also significant enough that a reasonable jury could find the songs intrinsically similar," wrote Circuit Judge Pamela Harris. 

Copeland claims Usher took the song to Bieber after a record scout played it for him. The suit was originally dismissed by U.S. District Judge Arenda Wright last year. 

“Somebody to Love” reached No. 15 on the Billboard singles chart.
